These Terms and Conditions govern your use of the Khrua Counsel website and the services offered by Khrua Counsel, operating from 64 Wualai Road, Haiya, Chiang Mai 50100, Thailand. By using our website or engaging our services, you agree to these terms.
1. Definitions
- "Service" refers to any legal consultation, drafting support, or case management provided by Khrua Counsel.
- "User" / "You" refers to any individual accessing our website or enquiring about or engaging our services.
- "We" / "Us" / "Our" refers to Khrua Counsel.
- "Agreement" refers to these Terms and Conditions, read together with any engagement letter or service agreement issued to you.
- "Content" refers to text, documents, and materials on our website or provided to clients as part of our services.
2. Acceptance of Terms
By submitting an enquiry form, contacting us by phone or email, or entering into a formal engagement with Khrua Counsel, you confirm that you have read, understood, and agree to be bound by these terms. You must be at least 18 years of age and have legal capacity to enter into an agreement.
3. Service Description
Khrua Counsel provides family law services in Thailand, including:
- First Conversation Consultations
- Agreement Drafting Support
- Comprehensive Family Support (case management and representation)
Services are available to individuals resident in or with matters arising in Thailand. Geographic restrictions may apply to specific service types. We reserve the right to decline to take on a matter without providing a reason.
4. User Responsibilities
When using our website or engaging our services, you agree to:
- Provide accurate and truthful information about your situation
- Not use our website or services for any unlawful purpose
- Respect the confidentiality of any documents or advice shared with you
- Notify us promptly if your circumstances change materially during an engagement
- Not reproduce or distribute content from our website without permission
5. Intellectual Property
All content on the Khrua Counsel website, including text, structure, and documentation templates, is the intellectual property of Khrua Counsel. Documents produced for a client as part of a formal engagement belong to the client upon full payment. No content may be reproduced for commercial purposes without written consent.
6. Payment Terms
Fees for each service are stated in Thai Baht (฿) and are as follows:
- First Conversation Consultation: ฿4,300 per session
- Agreement Drafting Support: ฿9,600 per agreement
- Comprehensive Family Support: from ฿17,300, with cost estimates provided per matter
Payment is required before or at the commencement of each service stage, unless otherwise agreed in writing. We accept bank transfer and cash payments at our office. Fees are non-refundable once work has commenced, except in cases of our error or failure to deliver the agreed service.
7. Consultation Terms
A consultation constitutes a private meeting for the purpose of providing general information about your legal position. It does not constitute the formation of a solicitor-client relationship unless confirmed in a formal engagement letter. Written summaries are provided within two working days of a consultation.
8. Disclaimers
Information provided during consultations and on this website is for general informational purposes and reflects the law as understood at the time of advice. Legal positions can change. Khrua Counsel does not warrant specific outcomes from any matter. Content on this website is not a substitute for tailored legal advice.
9. Limitation of Liability
To the extent permitted by Thai law, Khrua Counsel's liability in respect of any matter is limited to the fees paid for the relevant service. We are not liable for indirect or consequential losses. Nothing in these terms limits liability for professional negligence as defined under Thai law.
10. Confidentiality
We treat all information shared with us as confidential. We do not disclose client information to third parties except where required by Thai law, by the scope of services you have engaged (e.g. communications with a court), or with your explicit written consent.
11. Termination
Either party may terminate an engagement by written notice. Where a client terminates, fees are payable for work completed to that point. Where we terminate due to a breach of these terms by the client, fees already paid are non-refundable. We may also cease an engagement if continuing would place us in a professional conflict of interest.
12. Dispute Resolution
These terms are governed by the laws of Thailand. In the event of a dispute arising from our services, we ask that you contact us first to attempt informal resolution. If not resolved within 30 days, disputes may be referred to the courts of Chiang Mai Province, Thailand, which shall have non-exclusive jurisdiction.
13. General Provisions
- Entire agreement: These terms, together with any engagement letter, constitute the full agreement between the parties.
- Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
- Waiver: A failure to enforce any right does not constitute a waiver of that right.
- Assignment: You may not assign your rights under these terms without our written consent.
14. Changes to These Terms
We may update these terms from time to time. The effective date above reflects the most recent update. Continued use of our website or services following any update constitutes acceptance of the revised terms.
